Agreement to Terms

By accessing or using SendBroad, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. If you use SendBroadon behalf of a business, you represent that you have authority to bind that business to these terms.

Description of Service

SendBroadis a business messaging platform that enables you to connect your WhatsApp Business account through Meta's official APIs, create and manage message templates, run campaigns, and send WhatsApp messages to your customers at scale. Features, pricing, and availability may change over time.

Meta and WhatsApp Compliance

Your use of WhatsApp messaging through SendBroadis also subject to Meta's terms, policies, and WhatsApp Business policies, including acceptable use and messaging rules. You agree to:

  • Obtain valid opt-in consent before messaging recipients
  • Use only approved message templates where required by WhatsApp
  • Honor opt-out and block requests promptly
  • Not send spam, misleading, illegal, or prohibited content
  • Comply with applicable telecommunications, privacy, and marketing laws in your jurisdiction

Meta or WhatsApp may suspend or limit your account independently of SendBroad. We are not responsible for actions taken by Meta Platforms.

User Responsibilities

When using SendBroad, you agree to:

  • Provide accurate account and business information
  • Keep your login credentials secure and notify us of unauthorized access
  • Ensure contact data you upload is lawfully collected and used
  • Use the platform only for lawful business purposes
  • Pay applicable fees for subscribed plans on time

Prohibited Uses

You may not use SendBroad to:

  • Violate any law, regulation, or third-party rights
  • Send unsolicited bulk messages without proper consent
  • Distribute malware, phishing, or fraudulent content
  • Harass, threaten, or discriminate against individuals
  • Attempt to reverse engineer, scrape, or disrupt our systems
  • Resell or sublicense access without our written permission

Service Availability

We strive to keep SendBroad available but do not guarantee uninterrupted access. Maintenance, third-party outages (including Meta or WhatsApp API downtime), and force majeure may affect the service. We may modify, suspend, or discontinue features with reasonable notice where practicable.

Intellectual Property

SendBroad, its software, branding, and documentation are owned by us or our licensors and protected by intellectual property laws. You retain ownership of content you upload. You grant us a limited license to host and process your content solely to provide the service. You may not copy, modify, or distribute our platform without written permission.

Limitation of Liability

To the maximum extent permitted by law, SendBroad and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising from your use of the service or reliance on Meta or WhatsApp delivery. Our total liability for any claim shall not exceed the fees you paid us in the twelve months before the claim, or one hundred U.S. dollars if you use a free plan.

Termination

You may stop using SendBroad at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate your access immediately if you breach these terms, pose a security risk, or if required by Meta, law, or payment failure. Upon termination, your right to use the service ends; provisions that by nature should survive will remain in effect.

Appeal Officer

If we restrict, suspend, or terminate your account or messaging access, you may submit an appeal to our Appeal Officer. Include your account email, a description of the action taken, and why you believe the decision should be reversed. We will review appeals in good faith and provide a written response with our decision and reasoning.

Changes to Terms

We may update these Terms at any time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance. If you do not agree to revised terms, you must stop using the service.

Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts in India, unless otherwise required by mandatory consumer protection law in your country.
